Why the fair innings argument is not persuasive.Michael M. Rivlin - 2000 - BMC Medical Ethics 1 (1):1-6.
The fair innings argument (FIA) is frequently put forward as a justification for denying elderly patients treatment when they are in competition with younger patients and resources are scarce. In this paper I will examine some arguments that are used to support the FIA. My conclusion will be that they do not stand up to scrutiny and therefore, the FIA should not be used to justify the denial of treatment to elderly patients, or to support rationing of health care by (...)

Question: Do clinicians providing abortion practicing in states that restrict abortion experience more moral distress than those practicing in states that protect abortion? -/- Findings: In this national, purposive survey study of 310 clinicians providing abortion, moral distress was elevated among all clinicians, with those practicing in restrictive states reporting higher levels of moral distress compared with those practicing in protective states. -/- Meaning: The findings suggest that structural changes addressing bans on necessary health care, such as federal protection for (...)

Background: Current practice frequently fails to provide care consistent with the preferences of decisionally-incapacitated patients. It also imposes significant emotional burden on their surrogates. Algorithmic-based patient preference predictors (PPPs) have been proposed as a possible way to address these two concerns. While previous research found that patients strongly support the use of PPPs, the views of surrogates are unknown. The present study thus assessed the views of experienced surrogates regarding the possible use of PPPs as a means to help make (...)

    Reasonable Self-doubt.Ofer Malcai & Ram Rivlin - 2020 - Criminal Law and Philosophy 15 (1):25-45.
Sometimes, the availability of more evidence for a conclusion provides a reason to believe in its falsity. This counter-intuitive phenomenon is related to the idea of higher-order evidence, which has attracted broad interest in recent epistemological literature. Occasionally, providing more evidence for something weakens the case in its favor, by casting doubt on the probative value of other evidence of the same sort or on the fact-finder’s cognitive performance. We analyze this phenomenon, discuss its rationality, and outline possible application to (...)

The Supreme Court’s Dobbs v. Jackson Women’s Health Organization decision, first leaked to the public on 2 May 2022 and officially released on 24 June 2022, overturned Roe v. Wade and thereby determined that abortion is no longer a federally protected right under the Constitution. Instead, the decision gives individual states the right to regulate abortion. Since the Dobbs decision first leaked, our institution has received numerous requests for permanent contraception from individuals stating that their motivation to pursue permanent contraception (...)

This paper is intended first for the formal argumentation community (see https://comma.csc.liv.ac.uk/). This community develops logics and systems modelling argumentation and dialogues. The community is in search of major applications areas for their models. One such application area e.g. is Law. The message of this paper is that there is another major application area for formal argumentation. There is an international community of sex offender therapist that is well established and well funded, and their therapy methods use (methods that can (...)

Marital Contracts on the Fault Lines: A Liberal Inquiry.Shahar Lifshitz & Ram Rivlin - forthcoming - Canadian Journal of Law and Jurisprudence:1-35.
The revolution in Western family law over the past 50 years—often described as ‘liberalization’—involves a decrease in the importance of fault-based factors alongside an increase in the significance of marital contracts. While these two trends generally complement each other, they may conflict when a couple seeks to assign economic consequences to sexual fault through a contract. Should such an agreement be legally enforceable? Which aligns more with a ‘true liberal’ perspective: advocating against fault or for the use of contracts? This (...)

Religious But Not Ethical: The Effects of Extrinsic Religiosity, Ethnocentrism and Self-righteousness on Consumers’ Ethical Judgments.Denni Arli, Felix Septianto & Rafi M. M. I. Chowdhury - 2020 - Journal of Business Ethics 171 (2):295-316.
The current research investigates how religiosity can influence unethicality in a consumption context. In particular, considering the link between extrinsic religious orientations and unethicality, this research clarifies why and when extrinsic religiosity leads to unethical decisions. Across two studies, findings show that ethnocentrism is both a mediator and a moderator of the effects of extrinsic religiosity on consumers’ ethical judgments. This is because extrinsic religiosity leads to ethnocentrism, and in-group loyalty manifested through ethnocentrism increases support for unethical consumer actions, thus (...)

    Contribution of moral case deliberations to the Moral Craftmanship of prison staff: A quantitative analysis.Marie Huysentruyt, A. I. Schaap, M. M. Stolper, M. Snijdewind, H. C. W. de Vet & A. C. Molewijk - 2023 - International Journal of Ethics Education 8 (2):389-405.
This study explores the impact of participation in a series of moral case deliberations (MCD) on the moral craftsmanship (MCS) of Dutch prison staff. Between 2017–2020, ten MCDs per team were implemented in three prisons (i.e., intervention group). In three other prisons (i.e., control group) no MCDs were implemented. We compared the intervention and control group using a self-developed questionnaire, administered before (pre-measurement) and after the series of MCDs (post-measurement). Results After the MCDs, participants scored significantly higher on 7 of (...)

‘Equal though different’: laboratories, museums and the institutional development of biology in late-Victorian Northern England.Alison Kraft & Samuel J. M. M. Alberti - 2003 - Studies in History and Philosophy of Science Part C: Studies in History and Philosophy of Biological and Biomedical Sciences 34 (2):203-236.
Traditional accounts of the emergence of professional biology have privileged not only metropolis over province, but research over teaching and laboratory over museum. This paper seeks to supplement earlier studies of the ‘transformation of biology’ in the late nineteenth century by exploring in detail the developments within three biology departments in Northern English civic colleges. By outlining changes in the teaching practices, research topics and the accommodation of the departments, the authors demonstrate both locally contingent factors in their development and (...)

Prenatal screening pathways, as nowadays offered in most Western countries consist of similar tests. First, a risk-assessment test for major aneuploides is offered to pregnant women. In case of an increased risk, invasive diagnostic tests, entailing a miscarriage risk, are offered. For decades, only conventional karyotyping was used for final diagnosis. Moreover, several foetal ultrasound scans are offered to detect major congenital anomalies, but the same scans also provide relevant information for optimal support of the pregnancy and the delivery. Is the Flow of Time Subjective?M. M. Schuster - 1986 - Review of Metaphysics 39 (4):695 - 714.
LET ME BEGIN this inquiry with the simple but fundamental fact that the flow of time, or passage, as it is also known, is given in experience, that it is as indubitable an aspect of our perception of the world as the sights and sounds that come in upon us, even though it is not the peculiar property of a special sense. Consider, by way of illustration, that I am now sitting at the desk in my study. This particular event (...)

AN inquiry into the use of paradeigma in theIliadmust begin with Niobe. At 24. 602 Achilles introduces Niobe in order to encourage Priam to have some food. The dead body of the best of Priam's sons has now been placed on the wagon ready for its journey back to Troy. Achilles says, ‘Now let us eat. For even Niobe ate food, and she had losttwelvechildren. Apollo and Artemis killed them all; they lay nine days in their blood and there was (...)

Next SectionOne of the major concerns about surrogacy is the potential harm that may be inflicted upon the surrogate mother and the child after relinquishment. Even if one were to take the liberal view that surrogacy should be presumptively allowed on the basis of autonomy and/or compassion, evidence of harm must be taken seriously. In this paper I review the evidence from psychological studies on the effect that relinquishing a child has on the surrogate mother and while it appears that (...)

Consideraremos algumas figuras centrais (...)

Incessantly cited by critics, Bakhtin's work none the less remains relatively unavailable: partly through lack of suitable editions, partly because no individual text conveys all the key concepts or arguments. This anthology provides in a convenient format a good selection of the writing by Bakhtin and of that attributed to Voloshinov and Medvedev. In Australia and other countries, certain groups of women have traditionally been denied access to assisted reproductive technologies . These typically are single heterosexual women, lesbians, poor women, and those whose ability to rear children is questioned, particularly women with certain disabilities or who are older. The arguments used to justify selection of women for ARTs are most often based on issues such as scarcity of resources, and absence of infertility , or on social concerns: that it “goes against nature”; (...)

We argue that new meta-theoretically based applications of non-traditional perspectives of knowledge in science, and sport science, that highlights the question of ‘being woman’, and our understanding of woman as a social and biological being through sport, can enrich the general understanding of gender, identity, body and sport by developing and deepening a critical humanistic sport science perspective through athletes’ artistic reflections of their own athletic female body.
